Terms of Service
These terms are the agreement between you and SYNC ("SYNC", "we", "us") for using the SYNC app and website. We've tried to keep them readable. Please read them, especially the parts on safety, content and our liability.
- You must be 18 or older.
- Your content is yours. You give us only the permission we need to run SYNC for you and your partner. Most of it is end-to-end encrypted, so we can't read it.
- Your keys live on your phones. If you lose every way to restore them, past encrypted things can't be recovered, even by us.
- No nudity or sexual content, ever, even between partners. You can report anything and block or disconnect at any time, and no person at SYNC looks at your photos. We are rolling out automatic image safety checks in a later update. Three warnings close your account, with 14 days to appeal or save your things. You can always ask for a review, including by a person (who sees the details, never the photo).
- SYNC is not an emergency service.
- Games and exercises are for fun and connection. They are not therapy or professional advice.
1. Who can use SYNC
You must be at least 18 years old and able to enter a binding contract. You may not use SYNC if we've previously banned you, or if the law where you live prohibits it. By creating an account, you confirm that you meet these requirements.
2. Your account
- You sign in with Apple, Google or a one-time code sent to your email. Keep your email account and devices secure. We will never ask you for a sign-in code.
- Give accurate information, and use only your own account. One person, one account.
- You're responsible for what happens under your account. Tell us straight away at syncapp.noreply@gmail.com if you think someone else has accessed it.
3. Connecting with a partner
- SYNC works best when you connect with one partner. Only connect with someone you know and trust in real life, and only with their agreement. Never pressure anyone to connect, stay connected or share anything.
- Either of you can end the connection at any time from Settings, without needing the other's permission. When a connection ends, the shared space is archived and handled as described in our Privacy Policy: kept for 3 months, then deleted, and only restored if you both agree.
- To protect people, we may limit how often new connections can be made.
4. Your content
"Content" means anything you add to SYNC, such as photos, videos, voice clips, text, moods, letters, plans and game answers.
- You own your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display it, only to operate SYNC for you and your partner. That includes showing it to your partner, making backups, generating thumbnails, and handling reports and, once enabled, running the safety checks in section 6. Much of your content is end-to-end encrypted: we store it as scrambled data that only your and your partner's phones can read, and the licence covers storing and delivering it that way. This licence ends when your content is deleted, except for copies we must keep by law (see the Privacy Policy).
- Partner-shared content: what you share is meant for your partner, and they'll be able to see it. Please respect each other's privacy: don't publish, forward or share your partner's content outside SYNC without their clear permission, and never use it to threaten, shame or control them.
- You promise you have the right to share your content, and that it doesn't break the law or anyone else's rights (including copyright and other people's privacy, for example photos of people who didn't agree to be shared).
- Songs and links you attach (for example from Apple Music, Spotify or YouTube) belong to their owners and are subject to those services' terms.
- We don't claim ownership of your content and don't use it for advertising or to train AI models.
5. Acceptable use
SYNC is a place for kindness. You agree not to use SYNC to:
- share nudity, sexual or sexually suggestive images or video, or any adult content. This applies everywhere in the app, including between partners and including content of yourself;
- share, request or promote child sexual abuse or exploitation material, or sexualise minors in any way (see our Child Safety Standards);
- harass, threaten, stalk, intimidate, monitor or control another person, including your partner;
- share content that is violent, hateful, or encourages self-harm or illegal activity;
- scam people, impersonate anyone, or ask for money, gift cards, passwords or sign-in codes;
- connect with someone without their consent, or use another person's account;
- break the law or infringe anyone's rights;
- hack, probe, overload, scrape or reverse-engineer SYNC, get around its security or limits, or use bots or automated means to access it.
6. Safety checks, warnings and bans
- Our approach: nudity and sexual content are not allowed, even between partners. SYNC is a private two-person app, so the only person who can send you a photo is your paired partner. If your partner sends something that breaks this rule, you can report it and block or disconnect. We review reports and act. No person at SYNC looks at your photos, and no outside moderation company reviews them. Swimwear and underwear are fine. Voice notes are end-to-end encrypted; your partner's app plays them only as audio. Videos can't be uploaded for now. Photos are stored encrypted, and no person at SYNC can view them. Automatic image safety checks are not live yet; we are rolling them out in a later update and will update these Terms and our Privacy Policy when they are.
- Not shared: once automatic checks are enabled, if a photo might show nudity but the check isn't sure, it simply won't be shared, and that won't count as a warning.
- Warnings: content that clearly shows nudity or sexual content is removed and counts as a warning. Warnings don't expire, and they stay with you if you delete your account and sign up again.
- Three warnings: on a third warning your account is closed. We'll email you the dates. For 14 days you can still sign in to ask for a review or download your things; after that your account is deleted. A person whose account was closed may not create a new account, and we take steps to recognise returning accounts (see our Privacy Policy). We may also ban an account immediately for serious violations, for example threats of violence or scams.
- Child sexual abuse material: we have zero tolerance. We use, and are expanding, automated tools to detect known material by its fingerprint, and we act on reports. It's never simply deleted: it's sealed and preserved for at least one year, reported to the authorities as the law requires (including to NCMEC and the relevant Indian authorities) without anyone at SYNC viewing it, and the account is banned immediately. This is separate from the three warnings.
- Appeals and human review: warnings and closures can be mistaken. You can ask for a review straight from a warning or the account-closed screen in the app, or by following the steps on our support page, within 14 days. If you disagree with the outcome, you can ask a person to review the decision. They look at the details (dates, warning count and what you tell us), never the photo, and can overturn it or cancel the warning.
7. SYNC is not an emergency service
SYNC helps you stay close to your partner. It does not contact the police, ambulance, fire service or any emergency responder, and we don't monitor it. Messages and notifications depend on your phone, network and services outside our control, so they may be delayed or not arrive. If you or someone else is in danger, contact your local emergency number (for example 112 in India and the EU, 911 in the US and Canada, 999 in the UK) straight away.
8. Not therapy or professional advice
SYNC's games, questions, conflict-repair exercises (such as "After the Storm"), Gentle Days and other content are for connection and fun. They are not therapy, counselling, medical, health or professional advice, and they aren't a substitute for it. Gentle Days is not a contraceptive or medical tool. If you feel afraid of your partner, controlled or unsafe, these tools aren't right for that situation. Please reach out to someone you trust, a qualified professional or a local support service.
9. The service
- Your keys and recovery: because your shared things are end-to-end encrypted, the keys that open them are held on your and your partner's phones. You can restore them on a new phone through your iCloud Keychain or Google account backup (if you leave it on), your partner's phone approving, or your personal recovery code. Please save your recovery code. If all of these are lost, we can't recover your past encrypted content, and we have no way to reset it for you.
- We're constantly improving SYNC, so features may change, be added or be removed. We'll try to give notice of important changes.
- SYNC needs an internet connection, and some features need you to grant permissions (camera, microphone, photos, location, calendar or notifications). You can manage these in your phone's settings.
- SYNC is currently free. If we ever introduce paid features, we'll tell you the price and terms before you pay anything.
10. Apple and Google
If you downloaded SYNC from Apple's App Store, Apple's Licensed Application End User License Agreement also applies, and these terms add to it. Where they conflict, these terms apply to the extent the Apple EULA allows. You acknowledge that these terms are between you and us, not Apple. Apple isn't responsible for SYNC or its content, has no obligation to provide maintenance or support, and isn't responsible for any product claims (including product liability, legal or regulatory compliance, or consumer protection claims) or third-party intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If SYNC fails to conform to any applicable warranty, you may notify Apple for a refund of any purchase price (SYNC is currently free). To the maximum extent the law allows, Apple has no other warranty obligation. You confirm you're not located in a country subject to a US government embargo, and you're not on a US government list of prohibited or restricted parties. If you got SYNC from Google Play, Google Play's terms also apply.
11. Ending your use of SYNC
- You can stop using SYNC and delete your account at any time in Settings → Delete Account (see how).
- We may suspend or end your access if you break these terms (see section 6), if the law requires it, or to protect people or SYNC. Where it's reasonable and safe, we'll tell you why and how to appeal.
- If we ever shut SYNC down, we'll give you at least 30 days' notice and a way to download what you created.
- Sections that by their nature should continue (for example 4, 12, 13 and 15) survive termination.
12. Disclaimers
We work hard to keep SYNC running well and securely. But to the extent the law allows, SYNC is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability or non-infringement. We don't promise that SYNC will be uninterrupted, error-free or always available, or that content will never be lost. Nothing in these terms limits rights you have under consumer law that can't be excluded.
13. Limitation of liability
To the extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of SYNC or your relationship with any other user. Our total liability for all claims relating to SYNC is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) INR 5,000 (about USD 60). These limits don't apply to liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you're a consumer in the EU or UK, you benefit from any mandatory protections of the law of the country where you live.
14. Your responsibility to us
If you break these terms or the law and that leads to a claim against us, you agree to cover our reasonable losses and costs, to the extent the law allows.
15. Governing law and disputes
These terms are governed by the laws of India. Disputes will be handled by the courts of Surat, Gujarat. However, if you're a consumer, you may also bring proceedings in the courts where you live, and you keep the protection of mandatory consumer laws there. Before going to court, please contact us at syncapp.noreply@gmail.com so we can try to resolve things informally.
16. Changes to these terms
We may update these terms. For important changes, we'll tell you in the app or by email at least 14 days before they take effect, unless the change is needed sooner for legal or safety reasons. If you keep using SYNC after the change, you accept the new terms; if you don't agree, you can delete your account.
17. General
These terms, the Privacy Policy and the Child Safety Standards form the whole agreement between you and us. If any part is found unenforceable, the rest still applies. If we don't enforce a term straight away, we haven't waived it. You may not transfer these terms. We may transfer them as part of a merger or sale, with notice to you.
